IMD escalates warning: Red alert today, orange tomorrow

Panaji: The India Meteorological Department (IMD) has stepped up its weather warnings for Goa, issuing a red alert for Sep 24.
Heavy rainfall is very likely at a few places, and very heavy rainfall with extremely heavy rainfall is also very likely with winds gusting to 40-50 kmph at isolated places.
The IMD has attributed this to a cyclonic circulation over the central Bay of Bengal, which is expected to impact the state’s weather.The cyclonic activity, extending up to 5.8km above the mean sea level and tilting south-westwards, is expected to give rise to a low pressure area over the west central Bay of Bengal and its surroundings within the next 24 hours.
As a result, after a period of weakened activity, the southwest monsoon has regained strength over Goa, leading to isolated heavy rainfall in some areas on Monday.
Following the red alert for Sep, an orange alert has been issued for Sep 25, forecasting heavy to very heavy rainfall and wind gusts of 30-40 km/h. Additionally, a yellow alert has been issued for Sep 26.
Fishermen are strongly advised to avoid venturing into the sea during this period. Residents are urged to stay informed about the evolving weather situation and take necessary precautions in anticipation of heavy rain and potential disruptions.
As of Sep 23, the state has recorded a seasonal total of 166 inches of rainfall.

High court calls for joint inspection of razed Arambol site

Panaji: The high court of Bombay at Goa has directed a joint inspection by the secretary of the Arambol panchayat, an expert member of the Goa Coastal Zone Management Authority, and a member of the Goa Biodiversity Board of the site where illegal structures were demolished at Arambol after photographs were presented of the debris left on the site.
They are directed to visit the sites at Girkarwaddo and prepare a detailed report in two weeks.
The high court also directed the inspection team to determine the cost of the demolition of the structures as well as the costs for the restoration of the beach to its original condition so that the amount can be recovered from the former sarpanch.
The directions were issued after advocate Deepak Gaonkar, representing the Arambol panchayat, told the high court that the family members of the former sarpanch of Arambol failed to comply with court orders to demolish their structures. As a result, the panchayat had to remove 15 structures on Sep 17 and 18.
The division bench, while pursuing the affidavits with photographs of the structures that were demolished, saw a lot of debris scattered in the area.
The high court ordered the next hearing after two weeks to consider the report and determine whether the family failed to obey high court orders regarding the demolition of the 10 structures. The high court is hearing a suo motu petition concerning illegal constructions in Girkarwaddo, Arambol.

Karan Johar, who is also the executive producer on ‘The Tribe’ in a statement said, “The series promises to take viewers on an exhilarating journey, capturing a group of young, new-age content creators as they navigate their ambitions, aspirations, and unfiltered personalities while striving to make their mark in the major leagues.”
The streamer said, “This reality drama showcases a new generation of global young Indians who embody fearlessness and confidence as they create content with the aim of becoming bona fide social media stars.”
Meanwhile, Karan Johar has also signed to helm an upcoming series with Netflix. The script is finalized and KJo’s team will start production in early 2025. The series is expected to stream in 2026.

Dutch company gets Centre’s nod to study erosion across Goa’s beaches

Panaji:Union govt has granted its approval to state govt to engage a Netherlands-based company to evaluate the causes of erosion on Goa’s beaches in relation to local wave-driven currents, storm/cyclone erosion, and discharge at river mouths. The state will pay Deltares, the Dutch company, around Rs 32 lakh for the study.
“We have got the approval from Union govt to sign a memorandum of understanding (MoU) with the company,” environment secretary Arun Kumar Mishra told TOI.Over the ten-year period from 2004-06 to 2014-16, Goa has lost 15 hectares of land along its coast to erosion, according to a study by ISRO’s Space Applications Centre, Ahmedabad. The study also showed that Candolim — one of Goa’s most popular beaches for tourism — may have lost a significant chunk to erosion.
Candolim’s coast has been identified by the study as one of the country’s “erosional hotspots”. The high rate of erosion has been attributed to the earlier grounding of the River Princess off Candolim, which saw years of delay before it was removed. Research was taken up to quantify shoreline changes along India’s coast using remote sensing satellite images. State govt received a detailed proposal from Deltares, which will support local agencies in their studies on the local coastal morphology and their knowledge basis for decision-making on mitigation measures.
“We will assess the local situation from literature and in-house data. The aim is to provide a conceptual overview of the functioning of the local morphological system. We will discuss the outcome and the deliverable will be a concise report,” said the proposal submitted by Deltares to the environment department.
A three-day visit has been planned to the area with Deltares’ staff. “We can check the site characteristics and meet local authorities and stakeholders. Our aim is to create a joint understanding of the causes of erosion, to provide confirmation for the approach and perform first capacity building on the relevant coastal processes. We will summarise the discussed approach and further detail this in a concise report after the meeting,” the proposal said. The firm will support the modelling of the morphological system, and technical assistance will be provided to a local agency for the modelling of the morphological system and interpretation of the results, which will help obtain a quantification of the sediment transport rates.

NEW DELHI: Centre will soon formulate guidelines to deal with “health-washing”, amid a growing trend of companies making misleading claims to promote their products as more healthy by advertising that they contain multigrains, natural extracts, and are sugar free. In several cases, such products cost more.
Consumer affairs secretary Nidhi Khare said Monday that the issue of “health-washing” has come to the department’s notice, and it will start working on formulating norms to ensure consumers do not get misled.
She said guidelines for prohibiting “green-washing” and misleading advertisements by coaching centres are in the final stage, and will be released soon. The department is also carrying out consultation on prohibition of surrogate advertisements to protect consumers.
“Green washing” refers to companies or entities making misleading claims about how environmentally friendly their products, services, or operations are, while “surrogate ads” are marketing techniques that indirectly promote brands and products, such as tobacco and alcohol, which are banned from advertising.
There have been instances of alcohol and gutkha manufacturers promoting their brands through mineral water, playing cards and music CDs, and paan masala.
These violations fall under misleading advertisements of the Consumer Protection Act. As per the law, resorting to misleading advertisements can attract a penalty of up to Rs 50 lakh and a maximum of five years in jail.
Talking to reporters on the achievements of the first 100 days of the Modi govt, Khare said the department also wants e-commerce companies to stop selling banned and unsafe items through their websites.
It has started nudging them to sign a “safety pledge” to stop promotion and selling of such items through their portals.
As per the draft pledge, e-commerce companies will be expected to recall any hazardous or unsafe items being sold on their platform within 36 hours of being informed. “They also have to cooperate with government officials to identify the seller who is selling unsafe goods,” Khare said.
The department referred to global best practices such as in the European Union, Japan, Australia, South Korea and Canada while preparing the draft norms. Khare said a panel with members from major e-commerce platforms, voluntary consumer associations, industry bodies and national law universities is expected to submit its report in two weeks.

Panaji: The Save Old Goa Action Committee (SOGAC) submitted a memorandum to the chief minister’s office on Monday, with 4,500 signatures in support, demanding the formulation of a comprehensive masterplan and the halting of various commercial projects at Old Goa.
The signature petition, launched on Sep 15, and the memorandum were presented to the CMO since chief minister Pramod Sawant is the chairman of the St Francis Xavier Exposition Committee.The activists also demanded an appointment with the CM to discuss their concerns.
“The heritage of Old Goa is at risk due to unchecked commercial development. We believe it is crucial to establish a Master Plan that prioritises preservation over profit,” said a spokesperson for SOGAC. The group argues that without such a plan, the unique character and historical significance of the area could be irrevocably lost.
SOGAC also accused Rajesh Naik, the TCP chief town planner, of failing to oversee project approvals. They alleged that many of the illegalities plaguing the region have occurred during his tenure.

Santhy Balachandran, who made her debut with Tharangam in 2017, has acted in several films in different genres, taking on many challenging roles. This year, in particular, has been exciting for her so far, with her film Ennennum winning the International Critics Award at Neuchâtel International Fantastic Film Festival (NIFFF) in Switzerland and the Kerala State Special Jury Award for Female Director (for Shalini Ushadevi, director of Ennennum).The actress spoke to us about working on these projects, her Tamil film debut after the web series Sweet Kaaram Coffee, and screenwriting for an upcoming film. ‘A Malayalam-Tamil bilingual in the pipeline’
My next project is a Malayalam-Tamil bilingual starring Arya and a host of well-known stars from across the South Indian industries. The film is directed by Jiyen Krishnakumar and has been scripted by Murali Gopy. I’m excited to play one of the most intense characters I’ve been offered so far.
‘Ennennum excited me on a creative and intellectual level’
Ennennum is a project that excited me on a creative and intellectual level. A relationship drama set in a dystopian alternate present, the film explores how relationships — both personal and social — would be affected if we could become immortal via technology. I personally loved Shalini’s creative process. The recent international and state awards are a validation of her courage to craft a narrative that defies convention.
Gulmohar was one of the happiest sets I have worked in’
Not only was it a privilege to work alongside some of the legends of Indian cinema, it was also one of the happiest sets I have worked in. Rahul (director Rahul Chittella) made an effort to create an environment where the cast and crew could develop a comfortable equation. Both Gulmohar and Ennennum gave me characters that are very close to my heart, and it was a thrill to break the news of the National Award and State Award to Rahul and Shalini.
‘Working with Lakshmi ma’am and Madhoo ma’am was a gift’
Sweet Kaaram Coffee, my Tamil web series, was a special experience thanks to my wonderful co-actors. Lakshmi ma’am and Madhoo ma’am are remarkable women, and getting to share screen space with them was a gift. It was a pleasure conversing with them on everything, from acting to spirituality. Further speaking about OTT, the actress said, “The digital space has expanded the exposure and reach of actors working in regional industries. It has facilitated a cross-pollination of talent, with casting reflecting the diversity of our social fabric.”
‘Will soon get my First screenplay credit’
I will also soon get my first official screenplay credit for a movie starring Kalyani Priyadarshan and Naslen. I’ve written the additional screenplay for the project helmed by writer-director Dominic Arun. Filmmaking is a deeply collaborative medium, and with screenwriting, you get to be part of the creative process from the outset. There is something magical about watching your words transform into images and I’m excited to see where this new journey leads.

Parking notices to extra traffic staff, govt gives HC plan to decongest city

Panaji: Traffic police are acting against unauthorised vehicles parked across Panaji. A total of 1,070 cases of obstructive parking and parking violations along D B Marg have been booked since Jan this year. Additionally, 210 notices have been issued under the Motor Vehicles Act to violators for obstructive parking and no parking violation zones this year. A letter recommending cancellation of permits for 18 taxis, with multiple violations, has been sent to the transport department.Show cause notices have been issued to these habitual offenders by the department, govt told the high court in a suo motu writ petition on improving traffic in the city.
To ensure smooth traffic flow, staff from the traffic cell have been deployed at key locations along D B Marg, NIO Dona Paula Circle, Miramar Circle, indoor stadium, Kala Academy, Panaji market, Panaji ferry, Customs House, casino entry points and Divja Circle, govt told the high court. Govt also submitted that staff deployed near the casinos have been directed to divert buses to the internal road behind the old secretariat for pick-ups/drop-offs.

An officer from the traffic cell has been deployed at the integrated command and control centre (ICCC) at Altinho to monitor movement of vehicles through cameras and to respond at the ground-level. Representatives from the traffic cell, police department, and transport department have been given access to the monitoring, records, and the live feed at the ICCC at all times, the high court was told.They have also been provided with access to real-time data from the smart city cameras of different vehicles entering and exiting the city to help regulate the entry of heavy vehicles such as sewage trucks and goods carriers.
The Captain of Ports department had last Dec directed casinos to handle their sewage at the CoP jetty between 10pm and 7am.

Watching child porn on your laptop, PC or smartphone is now a punishable offence; 3-7 years jail and fine


The Supreme Court of India (SC) has ruled that the mere possession of child pornographic material, even if not disseminated further, constitutes a criminal offence. The court used the legal term “inchoate crime” to describe this act, which is defined as a criminal act committed in preparation for a further offence.
In a landmark judgement, the court emphasised the importance of the doctrine of inchoate crimes in criminal jurisprudence.This doctrine addresses the legal culpability of individuals who engage in preparatory actions that precede the commission of a substantive crime.
The court clarified that the intention behind possessing child pornographic material is punishable, regardless of whether there is an actual transmission of the content. The mere act of storing or possessing such material with a specific intention is considered a crime.

What the SC bench’s 200-page judgement said

“Inchoate crimes are defined as criminal acts that are committed in preparation for a further offence. The term ‘inchoate’ itself means ‘undeveloped’ or ‘incomplete’,” a bench of Chief Justice D Y Chandrachud and Justice JB Pardiwala said.
“What is sought to be penalised under Section 15 of the POCSO is the storage or possession of any child pornographic material when done with a particular intention or purpose as stipulated in sub-section(s) (1), (2) or (3), as the case may be. Thus, the bare textual reading of the said provision makes it clear that it is the intention which is being punished and not the commission of any criminal act in the traditional sense. This in the criminal jurisprudence is known as an ‘inchoate crime’ or ‘inchoate offence’,” Justice Pardiwala, who penned the 200-page judgement, said.
The judgement also addressed the concept of “constructive possession,” which means exercising control over contraband without physically possessing it. The court ruled that even if a person does not physically possess child pornographic material but has control over it, they can still be held liable under the law.
The Protection of Children from Sexual Offences (POCSO) Act provides various punishments for different offences related to child pornography. The act outlines penalties ranging from fines to imprisonment, depending on the nature of the offence.

What is the punishment

As a report news agency PTI writes, the section 15 of the POCSO Act provides different punishments of varying jail terms or fine or both:
* Section 15 (1), which deals with possession of child pornographic material, provides for a minimum fine of Rs 5,000 which may extend to Rs 10,000.
* Section 15 (2), which deals with possession of child pornographic material for dissemination, entails jail term of up to three years or fine or both.
* Section 15 (3), which deals with use of such materials for commercial gains, provides for three years to five years of jail term for first-time offenders or with fine or both.
* Repeat offenders can be awarded jail terms ranging from five years to seven years along with a fine.
